Das Buch unterstreicht, dass das Recht ohne das alltägliche Rechtsverständnis von Laien undenkbar ist. Es geht von der Annahme aus, dass nicht nur die Existenz des Rechts, sondern auch seine Entwicklung durch die Unterstützung, Ablehnung, Ignoranz oder Akzeptanz von Laien geprägt wird. Dieses Werk zielt darauf ab, eine Lücke in der sozialrechtlichen Forschung zu schließen, welche die Rolle von Laien in der Entstehung und Weiterentwicklung des Rechts bisher weitestgehend ausblendet. Während viele sozialrechtliche Theorien das Recht durch das Handeln von Rechtsexpert*innenen, Institutionen, Verfahren und Kodifikationen konzeptualisieren, argumentieren die Beiträge in diesem Sammelband, dass eine solche Sichtweise die Rolle der Laien im Rechtsprozess unterschätzt und plädiert für eine stärkere Berücksichtigung ihrer Funktionen in der rechtssoziologischen Theorie.
